Terms of Service

These Terms of Service ("Terms") govern your use of CallWise AI, a service provided by Dendrites Technologies Co, a Texas limited liability company ("CallWise," "we," "us," or "our"). By creating an account, using the service, or clicking "I agree," you accept these Terms.
1. Service Description
CallWise AI is a software-as-a-service platform that answers phone calls on behalf of small businesses using artificial intelligence. The service routes calls placed to a customer-owned phone number (forwarded through the customer's telecom carrier) to the CallWise AI system, which conducts conversations, takes messages, sends follow-ups, and delivers call reports.
2. Subscription Terms
CallWise AI is a subscription service billed monthly. A valid payment card is required at signup. Subscriptions automatically renew on the monthly anniversary of the first paid charge unless canceled before the next billing cycle. Plan pricing and call limits are displayed at signup and in your billing portal.
3. Free Trial
New accounts receive a 7-day free trial with up to 10 answered calls included. A payment card is collected at signup. At the end of the 7-day trial period, or when the 10-call limit is reached — whichever comes first — your card is automatically charged for the selected plan and the subscription begins. You can cancel at any time before conversion by visiting the Stripe-hosted billing portal linked from your dashboard.
Each business is eligible for one free trial. Re-signing up with the same email, phone number, or EIN will not re-start the trial.
4. Cancellation
You can cancel your subscription at any time from the Stripe-hosted billing portal linked in your dashboard. Cancellation takes effect at the end of the current billing period. No pro-rated refund is issued for partial months except as described in our Refund Policy.
5. Acceptable Use
When using CallWise AI, you agree not to:
- Use the service for illegal calls, robocalling without consent, or any activity that violates the Telephone Consumer Protection Act (TCPA) or similar state laws.
- Harass, defraud, or deceive callers.
- Generate unsolicited commercial messages (spam) from the service.
- Impersonate another business, person, or government entity.
- Use the service to collect protected health information (PHI) without a signed Business Associate Agreement (BAA).
- Attempt to reverse-engineer, scrape, or re-sell the service.
- Exceed reasonable fair-use limits such that service for other customers would be degraded.
We may suspend or terminate accounts that violate these rules without refund. Serious violations may be reported to relevant authorities.
6. Intellectual Property
CallWise and its affiliates retain all right, title, and interest in the CallWise AI software, models, interfaces, branding, and documentation. Subject to the Terms, you receive a limited, non-exclusive, non-transferable license to use the service for your business.
You retain ownership of all content you provide — your business information, prompts, call recordings, transcripts, caller data, and anything else you or your callers input. You grant CallWise a license to process that content solely to operate, improve, and support the service.
7. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
8. Data Retention
Call records (metadata, transcripts, reports) are retained for 365 days after the call date. Call recordings are retained for 30 days in "hot" storage (immediately retrievable) and an additional 335 days in "cold" archive storage, for a total of 365 days, after which they are permanently deleted. Billing records are retained for 7 years to comply with tax and audit obligations. You may export or request deletion of your data at any time as described in the Privacy Policy.
9. Limitation of Liability
The service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. CallWise disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated conversations may contain inaccuracies; you are responsible for verifying critical information before relying on it.
In no event will CallWise's aggregate liability for any claim arising out of or relating to these Terms or the service exceed the total fees you paid in the 12 months preceding the claim. CallWise is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost business opportunities.
9a. SMS Messaging Terms (A2P 10DLC)
These SMS-specific terms apply to the CallWise Chief of Staff SMS program ("the Program"), operated by Dendrites Technologies Co under A2P 10DLC Campaign registration with The Campaign Registry.
Program description. The Program sends transactional SMS messages on behalf of a verified CallWise account owner to recipients that the account owner has explicitly named during a live voice call or added to a pre-approved contact list during account setup. Messages relate to the account owner's personal and business communications — schedule updates, draft confirmations, payment reminders, and task follow-ups. No marketing, no third-party data sharing.
How to join. The account owner consents to the Program by accepting these Terms of Service. Message recipients are named verbally by the account owner during authenticated voice sessions; the AI reads the draft back and sends only after an explicit spoken "send" confirmation. Recurring recipients are added to a pre-approved list at account setup, with the account owner attesting that the recipient has given verbal permission to be contacted via SMS.
Message frequency. Message frequency varies by account usage; a typical recipient receives fewer than 10 messages per month. Message volume is capped by the account owner's voice sessions and their pre-approved contact activity.
Message and data rates. Message and data rates may apply. Carrier rates vary; contact your mobile provider for details. CallWise does not charge recipients for messages sent or received.
Help. For help, reply HELP to any message, or email support@dendritesai.com. You will receive a reply with program information and support contacts.
Opt-out. You can unsubscribe from the Program at any time by replying STOP, STOPALL,UNSUBSCRIBE, CANCEL,END, or QUIT to any message. You will receive a confirmation that you have been unsubscribed and will receive no further messages from the Program. To resubscribe, replySTART or contact support. Opt-out is honored globally across all CallWise SMS campaigns and across carriers.
Supported carriers. T-Mobile, AT&T, Verizon Wireless, Sprint, Boost, MetroPCS, U.S. Cellular, Cricket, and most regional and MVNO carriers. T-Mobile and its subsidiaries are not liable for delayed or undelivered messages.
Privacy. Recipient phone numbers are used solely to deliver the messages requested by the account owner and are stored with the account owner's contact records. Numbers are never sold, rented, or shared with unrelated third parties. See our Privacy Policy.

10. Indemnification
You agree to indemnify and hold CallWise harmless from claims arising out of your use of the service, including but not limited to TCPA violations, claims from callers regarding conversation content, claims regarding collected or stored data, or claims arising from your breach of these Terms.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be announced by email to the account owner at least 30 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Disputes arising out of the Terms will be resolved exclusively in the state or federal courts located in Dallas County, Texas.
